For a neat little case dealing with the difference between contract and gift, see Richert v. Stewards' Charitable Foundation 2005 BCSC 211 affirmed 2006 BCCA 9.

The case will also be interesting for those interested in the gift mistake rules since it seemingly indicates that a merely causative mistake is not enough to upset a gift.
