aside, the CA's timing is "seasonally" unfortunate unless there
was some urgency we don't know about. Otherwise? Two weeks before
holiday season? Ouch. Culligan (or its insurer) probably didn't
need the present. Why ruin it for the Mustaphas?

if the SCC allows leave I'll eat two. It may be time the court
attended to the issues in this case, and the facts may well be
clean, but the judgment of Brockenshire J. at trial was so wacky
that I would think the SCC would want to refuse leave just to
emphasize how right the Ont. C.A. was in the result.
