Subject: Presumption of Advancement
Dear Colleagues:
According to The Lawyer's Weekly the Supreme Court of Canada has abolished the presumption of advancement for transfers between parents and adult children (even disabled adult children) in two recent cases. See Madsen Estate v. Saylor, 2007 SCC 18 (May 3, 2007) and Pecore v. Pecore, 2007 SCC 17 (May 3, 2007).
