Subject: A Fly in the Bottle This Time, Part III
Dear Colleagues:
The SCC has given leave in Mustapha v. Culligan of Canada Ltd. The case concerns a plaintiff who claimed damages for psychological distress caused the discovery of a dead fly (and parts of another) in a bottle of water purchased from the defendant. For more background see here.
I am always afraid what the SCC will do with a case like this.
