Very unusually, she actually put the ‘without prejudice’ settlement offer in the record on the basis that it went to the issue of punitive damages.

But I think they were really only offering to write off most of the bill, with her still paying $2,000.
Then there was a cheque sent by Rogers personally, for $5,000, which she has never cashed on the ground that she wanted to deal with the company as such.

I met her at a conference in June and she said she spent her whole sabbatical on this.

From the report, it appears she should have had a punitive costs award made against her since her recovery (even with the punitive damages) was well below the $10,000 settlement offered by Rogers. Lucky she was in small claims court.
