Summers on Mitigation in the Law of Damages
Dear Colleagues:
Congratulations go out to ODGer Andrew Summers on the publication of his
new book, Mitigation in the Law of Damages, with OUP.
From the description:
- The first comprehensive treatment of the law of
mitigation in any common law jurisdiction
- Overturns conventional textbook accounts of the
legal rules of mitigation
- Engages with contemporary debates about the
theoretical structure of the law of damages
- Revives and develops insights from Hart and
Honor 's ground-breaking work 'Causation in the Law'
- Explains the relationship between mitigation and

I have been told that in addition to a doctrinal analysis of the law of
mitigation, the book also includes an extensive discussion of private law
methodology (Introduction and Ch4) and implications for the concepts of loss
and causation, and rights-based theories of damages (Conclusion) which may be
of interest to private law theorists.
