Common and Civil Law:

Different Paths or Convergence?

In our legally plural world the discourse on norms and rules is expanding rapidly.  No where is this more true than in the realm of private law.  As the global economy expands, and barriers to trade and commerce fall, regimes of private law must account for the influence of other factors introduced by contact with other legal systems.  This is particularly true in Canada, which maintains two seemingly distinct private law regimes through our continued reliance on both common law and the civil law of Qu bec. 

How these two systems connect or interact is the subject of the Fourth Canadian Law of Obligations Conference to be held at the Facult de droit at the Universit de Montr al on October 3-4, 2024. This year s conference is devoted to exploring the extent to which common and civil law are moving toward convergence in the area of private law.  Are there still two legal solitudes or are we approaching something akin to a truly mixed jurisdiction ? Ancillary questions involve how common and civil law come into conflict, enhance uniformity, or create confusion in other common and civil law jurisdictions. 

We invite submission of abstracts relating to the conference theme in the areas of torts, contracts, trusts, restitution, unjust enrichment, remedies, or other areas of Canadian private law. At the same time, we also welcome papers on other topics in Obligations not strictly related to the conference theme.  Submissions may be of either complete papers or works in-progress.   A limited number of papers may be invited for inclusion in a published essay collection on the conference theme following the event.

We seek contributions from both established and newer scholars.

We welcome papers and presentations in English or French.

 

Participants will be responsible costs of travel and accommodation.
