The
new H.L. case of Wainwright v. Home Office (see http://www.publications.parliament.uk/
pa/ld200203/ldjudgmt/jd031016/wain-1.htm) deals with whether
the common law should recognize a tort of invasion of privacy or
extend the principle in Wilkinson v Downton [1897] 2 QB 57 to deal
with, on the facts of the case, unauthorized strip searches of prison
visitors.
