Subject: Mistake of law

 

A predictable but still important development. In Brennan v Bolt Burdon [2003] EWHC 2493 (QB) Morland J accepted that the mistake of fact / mistake of law dichotomy has disappeared in contract as it has in restitution, and duly set aside a compromise of proceedings on the basis that it had been made under a mistake of law.
