Subject: New Fiduciary Duty Textbook

 

Dear Colleagues:

Those of you with an interest in equity may be interested to learn that there is a new Canadian textbook on the subject: Dr. Leonard I. Rotman, Fiduciary law (Toronto : Thomson Carswell, 2005) 900 pages.

From the Description:

The book is designed to fill a void in existing fiduciary literature and jurisprudence. It addresses those issues most salient to forging a sophisticated understanding of the fiduciary concept so that it may be better understood and more appropriately used by judges, legal practitioners and academics. The book develops a greater understanding of the fiduciary concept by examining its ideological, historical and jurisprudential foundations. It also develops a new vision of the fiduciary concept and a functional method for its implementation. The book addresses many of the problems in the contemporary application of the fiduciary concept, followed by more specific consideration of types of relations that are said to be fiduciary.
