members may be interested to note that, according to BBC News online,
Duwayne Brooks, the surviving victim of a notorious racist attack
in London, has been "awarded" £100,000 damages by
the Metropolitan Police in an out-of-court settlement. Last year,
the House of Lords struck out his claim for negligence against the
police: [2005] UKHL 24, [2005] 1 WLR 1495. It appears that his action
continued on the basis that the police were liable for false imprisonment,
misfeasance in public office and breaches of section 20 of the Race
Relations Act 1976.
