This judgment concerns recovery of a priceless painting looted in Germany after the war, and traded by Moscovite art smugglers during the 1980ies. Main points:

- A judgment by Mr Justice Moses of the High Court becomes the first judicial authority on a 100 year old provision of the German Civil Code.

- Conflict of laws: restitution and proprietary claims

- Conflict of laws: limitation of actions in cases of double actionability in restitution and tort

- Application of foreign law, interpretation of foreign statutes
