The Australian case of Palmer v Blue Circle Southern Cement Ltd (1999) 48 NSWLR 318 (NSW SC: Bell J) digested at [2001] RLR 137 #36 provides clear authority for the view that a change of position may be made out where the recipient of a benefit in reliance on such receipt forgoes an entitlement to make a claim on another source.
