Further to my posting of 25 Sept 04, the International Herald Tribune had a story on Friday regarding the progress of the US federal government's attempt to recover billions of profits from the tobacco companies. The trial judge held that civil RICO does allow disgorgement as a remedy but has permitted an interim appeal on this point of law, which has now been heard:
